Accidents at work, occupational diseases, occupational health and safety (OHS)
One of the most important obligations of the employer is to provide employees with safe and healthy working conditions. Unfortunately, even the best-organised OHS services cannot fully eliminate the risks related to accidents at work or occupational diseases. Their occurrence may result in serious and measurable consequences for the employer, including financial ones.
Because of the quite frequent problems with the interpretation of the OHS regulations and standards referring to the obligations of employees and employers, we advise our Clients on issues such as reventive medical check-ups, fulfilment of the obligation to undergo OHS training, creation and updating of occupational risk assessments (including in the case of remote work).
Specialists
Under this area of practice, we:
- assist in conducting post-accident proceedings and drawing up post-accident reports or accident cards as well as in conducting proceedings regarding suspicion of an occupational disease (including fulfilment of information obligations to the relevant authorities);
- provide solutions to minimise burdening employers with liability for accidents at work and occupational diseases;
- represent employers in proceedings before control authorities (National Labour Inspectorate /PIP/, State Sanitary Inspection /PIS/) and before courts in proceedings concerning accidents at work and occupational diseases;
- consult terms of cooperation between Clients and contractors (including persons hired under civil law contracts and temporary employment agencies) in the context of OHS;
- draft regulations regarding collaboration of companies in the field of OHS under concluded cooperation agreements;
- advise Clients on an ongoing basis regarding verification of the fulfilment by employees of individual OHS obligations, including the obligation to undergo prevention medical check ups or participate in OHS training, as well as obligations of the employer related, for example, to drawing up lists of prohibited works, occupational risk assessment, allocation of work clothes and footwear or personal protective equipment.
